Munalula, Shilimi, Mapani to decide if they’ll recuse themselves from hearing Lungu’s eligibility case

The Constitutional Court is this afternoon expected to render a ruling on whether or not, the three Judges presiding over former president Edgar Lungu’s eligibility case will recuse themselves for alleged bias.

The three Judges include the president of the Constitutional Court Justice Margaret Munalula, vice-president of the Constitutional Court Justice Arnold Shilimi and Justice Maria Mapani Kawimbe.

This follows Lungu’s application to ask the three judges to recuse themselves from presiding over the matter.

Lungu has submitted that Justice Munalula was one of those who was complained against in 2016 together with the other three Judges now appearing before the Judicial Complaints Commission (JCC) and stood suspended.

He submitted that Justice Shilimi was a close associate to President Hichilema and Justice Kawimbe was family with President Hichilema.

The former head of state submitted that if the three judges continue to preside over the matter, he is likely to suffer unfair trial.
