Chabinga ignored court order because he knows Judiciary is in disarray – Changala

Civil rights activist Brebner Changala says Mafinga member of parliamnet Robert Chabinga knows the judiciary is in disarray the reason he has chosen to ignore a court order.

On Sunday, Chabinga expelled from the PF faction leaders Miles Sampa, Edgar Lungu and Raphael Nakacinda.

This was done despite Sampa obtaining an injunction stopping the press briefing from going ahead.

Speaking in an interview with Daily Revelation, Changala said Chabinga knew that the Judiciary could not do anything to him even if he defied a court order which stopped him from holding a press briefing.

“Fast forward, when Miles Sampa decided to go and reconcile with the other faction, the legitimate faction, the executive decided to remove Miles Sampa through Chabinga at the Registrar of Societies, an illegal maneuver not supported by any law, no matter how substandard that law must be,” Changala said.

“They go and change the office bearers and to do that Miles Sampa decides to obtain an injunction to stop the installation of Chabinga as acting president. Chabinga knowing too well that the judiciary is in disarray, and it is powerless, decided to ignore a legitimate court order because he has the full support of the executive.”

He said the lawlessness that Chabinga was exhibiting was inspired by the executive arm of the government.

Changala added that the judiciary knowingly or unknowingly had allowed the executive to abuse it.

He said the UPND came to power on the backbone of change and restoration of the rule of law but the agony being faced today was lawlessness inspired by the executive.

Changala also said the executive was overbearing on the other two arms of government, namely the judiciary and the legislature.

He further said the judiciary had lost the public support yet it was the last arm, or the last line of defense for any aggrieved individual, institution, company or any society.

Changala said the judiciary was an accomplice to the confusion in the PF because it had failed to answer just one simple question which was whether the constitution of the PF allowed someone to hold the convention and change leadership.

He also noted that the beginning of this chaos began with the Sampa’s illegal convention on October 24, 2023.

“When the judiciary decided to be a willing player in lawlessness, the matters that went before Judge Chocho, which were never adjudicated upon and deliberately so. The matter ended up with Judge Chiloka, who equally adjudicated on the matters with laissez faire. And the PF, Miles Sampa saga has never been resolved. If anything, the legitimate office bearers of the PF just walked away because there was no hope in the judiciary,” Changala said.

However, when asked if he was not regretting supporting the UPND government whilst they were in opposition considering the things he was not happy about, Changala said he did not regret it, because PF needed to go.

“I do not regret, we needed to change the regime, the PF had to go. And we needed to bring in the new dawn administration, which had promised to come and restore order. Which had promised to come and restore the rule of law,” he said. “But we were cheated. They lied to us and they got our support and the moment they won the elections, we now know their true colors that they are schemers.”

Changala said as it was today, the county had experienced a lying regime, with a lying leadership.

He said if the UPND had carried out what they had promised the Zambian people, today they would still be celebrating the new dawn.

“But 90 percent of the people who supported the UPND have parted company. 90 percent have parted company not because they are mad, because they feel cheated,” said Changala.
