BOWMAN, MALANJI HAVE NOT BEEN ‘HUNGED TO WIRE’, ARGUES MAKEBI

Lawyer representing Bowman Lusambo and Joe Malanji, Makebi Zulu, saying it’s not over for the duo over their aspirations to contest the Kabushi and Kwacha by-elections respectively.

Speaking with Daily Revelation, Zulu argued that the court submitted that there was an order from the courts stopping the elections, saying that was what the Constitutional Court merely confirmed, that ECZ could not call for fresh elections because there was an order of the court staying the elections.

“So there are no elections going ahead,” Zulu said and called the celebrations against Lusambo and Malanji as merely propaganda because there was nothing stopping the duo, “until that order staying the elections.”

He said “for now there will be no fresh nominations until the pending judgement of the High Court”, insisting that there was an appeal that has gone before the Court of Appeal and the proceedings in the High Court were stayed.

“So we are still waiting for that judgement in the High Court. For as long as that judgement in the High Court has not been delivered there will be no elections in Kwacha and Kabushi. That is the order from court I am saying,” Zulu said.

But asked on the mocking going around that while Lusambo and Malanji have been “hunged”, he and his other lawyer will be smiling their way to the Bank on the legal services accrued from representing their clients, Zulu said Lusambo and Malanji have not been hunged to the wire, saying the position was as he had stated over the order from the court stopping the ECZ from conducting the elections until the High Court delivers judgement.

He also argued that the Constitutional Court was very clear that when there are court proceedings, elections can be held after the 90-day period required to hold elections when there is a vacancy.
