Governance Elections Advocacy and Research Services (GEARS) Initiative executive director MacDonald Chipenzi says Anti-Corruption Commission (ACC) director general Gilbert Phiri is on point over discontinuing cases against thieves who surrender stolen properties.
Speaking with Daily Revelation, Chipenzi said ACC will simply be enforcing the law provided as there is no illegality in allowing suspects charged with corruption cases to surrender properties believed to have been acquired from proceeds of crime.
Chipenzi, however, suggested taking such a move provided the suspect is candid enough to make full disclosure of the proceeds of crime.
“He (Anti-Corruption Commission director general Gilbert Phiri) has a point and the point anchored on law. Also it is not a new happening as it has happened before, like in the case of Faith Musonda,” stated Chipenzi. “Unlike we also saw in one incident where the suspect under declared, this section of the law must only be used when the supsect is candid enough to disclose all the proceeds of crime. As long as the law allows such, the Commission will not be doing any illegality.”
He also said that the disclosure of proceeds of crime should be done transparently to avoid any suspicions or compromise.
“Therefore, such must be done, but done transparently to avoid any suspicions or compromise,” added Chipenzi.
