PF presidential aspirant Chishimba Kambwili says what Director of Public Prosecutions (DPP) Shawa Siyuni has done is a clear case of misconduct and must immediately resign from her office.
Speaking with Daily Revelation on the letter Siyuni wrote to the Drug Enforcement Commission (DEC) director general that the commission’s decision to re-arrest Milingo Lungu was ultra vires the constitution which solely gives the DPP’s office the power to give instructions on prosecution of matters, Kambwili described Siyuni’s action as very grave.
Milingo was re-arrested on the same charges the DPP had earlier entered a nolle in plus another charge of allegedly being in possession of the house in Lusaka’s Sunningdale area reasonably suspected to be proceeds of crime.
Kambwili said Siyuni overstepped her boundaries.
“If she did that that is very grave. That’s extremely grave. I have always thought that she refused to give consent to prosecute. No, no, no, if she wrote telling them to stop the investigations, no! She overstepped her boundaries. She overstepped her boundaries,” Kambwili said. “If she did a letter to ask to stop the investigations there is nothing she can do, she has to resign. Unfortunately, she just has to resign. I withdraw what I said about changing DPPs. Here there is a clear case. There is a clear case of misconduct. This is a clear case of misconduct, I have never paid attention to the details of what transpired, me I thought people started calling for her because she refused to give consent to prosecute. No! But if she wrote a letter telling the DEC not to investigate that is misconduct.”
Kambwili insisted that it was not in the DPP’s power to investigate matters, as her role was confined towards authorizing prosecutions.
