Isoka member of parliament Majory Nakaponda (PF) has sued jailed former Lusaka Province minster Bowman Lusambo demanding damages for breach of contract and an order for the recovery of K375,000.
Nakaponda who has cited Lusambo as a respondent also wants interest on the claimed money, costs and incidental to these proceedings.
According to a statement of claim filed in the Lusaka High Court on February 10, 2025, Nakaponda stated that on April 28, 2024, she and Lusambo entered into a contract of sale of a house located in Silverest in Chongwe, Lusaka.
She submitted that the purchase price of the said house was K600,000 as agreed upon by both parties.
“In pursuance of the said contract, the plaintiff made payments to the defendant amounting to K375, 000,” she stated.
Nakaponda further submitted that on June 5, 2024, she contacted Lusambo informing him that she was ready to clear the balance of the purchase price so that she could obtain possession of the property.
She stated that Lusambo responded that he would collect the money within a week or so.
“To the plaintiff’s surprise, however, the defendant suddenly stopped picking the plaintiff’s calls and avoided all manner of communication,” she stated.
Nakaponda further stated that on October 14, 2024, she issued a demand letter seeking a refund of the sums paid to the Lusambo.
She stated that although Lusambo undertook to pay back the money, he failed and or neglected to do so despite several reminders.
“The plaintiff will aver that on account of the dishonest conduct of the defendant, the plaintiff has experienced financial loss and emotional destress,” stated Nakaponda.
