The Lusaka High Court has found former Mongu judge Wilfred Muma with a case to answer In a matter where he is charged with wilfully failure to comply and abuse of office.
This is in relation to his tenure in office as commissioner of lands were it is alleged that he deprived the Zambia Army of its land, which he illegally issued to the PF.
Sitting under the Economic and Financial Crimes Court High Court division, judges Pixie Yangailo, Anne Ononuju and Ian Mabbolobbolo ruled that the prosecution had proved their case.
In March last year, judge Muma pleaded not guilty to wilfully failure to comply with procedure and abuse of office.
It is alleged that judge Muma between April 1,2018 and December 31,2018 whilst serving as commissioner of lands failed to comply with Section 84(f) of the lands and deeds registry Act chapter 185 of the Zambian laws when he instructed his subordinates to cancel certificate of title no.21818 relating to property no.Lusaka/LN_8426/1 without following applicapble procedure.
Judge Muma is on the same dates alleged to have abused his power by requesting the Army commander to surrender the certificate of title in relation to property no.Lusaka/LN_8426/1 and offering it to the Patriotic Front Party an act arbitrary and prejudicial to the interest of Government.
