LET’S ABOLISH CONCOURT, URGES UPND OFFICIAL

UPND Central Province information and publicity secretary Fred Khunga has called for the abolishment of the Constitutional Court.

Khunga has charged that the Constitutional Court has failed to live up to the objective of addressing Constitutional conflicts in the country, but has mostly been leaving ordinary citizens more confused.

“Our expectations were that the Constitutional Court will go a long way in addressing Constitutional conflicts in the country. We were thinking that the Constitutional Court will be instrumental when it comes to interpreting the law. But what we have realised is that the ConCourt has failed to live up to the expectations of the Zambian people. Instead it has been leaving ordinary people even more confused with the legal jargon and the so called lacunas,” Khunga explained in an interview.

He said that the country is better left with the High Court and Supreme Court to preside over Constitutional conflicts, adding that in its current form the Constitutional Court is a drain on public resources.

“We thought the High Court will now concentrate on adjudicating specific matters so that the Constitutional Court can also attend to Constitutional conflicts and interpretation of the law. But at the rate at which we are moving, I think the ConCourt can only be given 50 per cent. The institution is underperforming,” said Khunga. “The Constitutional Court has proved to be a drain on public resources. In fact, we are better off with the Supreme Court and the High Court.
