Court revokes bench warrant against Mwewa following his apology

Lusaka Magistrate Kawama Mwamfuli has revoked the bench warrant issued against social media vlogger Chitambala Mwewa commonly known as Simon Mwewa Lane for failing to testify as a witness.

In November last year, the court issued a bench warrant against Mwewa after he failed to testify as a witness in the matter in which PF central committee member Chishimba Kambwili is facing one count of unlawful assembly.

When the matter came up for explanation on why the bench warrant was not executed on Monday, police officer Micheal Matafwali informed the court that steps to execute the bench warrant were made but the warrant was not given to the accused.

And Mwewa who was seated in the accused dock apologised to the court saying that he was unable to come to attend court because he forgot.

“My sincere apologies. If I may be allowed to say that the time I was supposed to appear, I had another matter at High Court and I was given a date of 19th December, and due to circumstances, I forgot. I apologise, I did not meet any police officers. I’m so sorry. I apologise and I’m ready to testify,” said Mwewa.

The court gave Mwewa the benefit of the doubt and warned the state to ensure it brought all its witnesses at the next sitting or close the case.

“The witness is ready to testify, and I have given him the benefit of a doubt. Therefore, the bench warrant is revoked,” ruled the court.

Matter comes up on March 6, 2025, for continued trial.
