Magistrate Boniface Mwala has ordered a medical checkup on Petauke-Central member of parliament Emmanuel Jay Jay Banda after he developed another medical condition while in police detention.
This is the third medical condition Banda is developing before the police, with one of them having resulted in him collapsing as he was being interrogated by the men in uniform.
His lawyer Kennedy Mambwe informed the court when Banda appeared in the Chipata Magistrates Court for explanation of the charges of attempted murder and aggravated robbery that he is facing, that while in detention, his client had developed another medical condition.
The lawyer made an application so that his client could be checked and the magistrate equally granted the application ordering that Banda undergoes medical check up at Chipata Central Hospital.
Friends, family and sympathisers attended court and Chief Mumbi of the Nsenga people of Petauke was among the people who attended court.
Banda was seen being assisted to walk by unidentified men as he was being taken to the court room.
He appeared before the Chipata Magistrate’s Court slightly after 14:30 hours under heavy police presence.
After explanation of the charges, Banda through Mambwe made an application for the court to conduct a preliminary inquiry to examine whether part of the new charges he was facing, were similar to those he was facing in 2016 where he was tried and the matter was disposed off.
But State advocate Sydney Siyanfwa objected to the application saying it was immature because the defence was not privy to the facts that the State had regarding the new charges.
Magistrate Mwala reserved ruling on the application to Friday next week.
