KABIMBA THREATENS NKOMBO WITH COURT ACTION OVER 156 LAND CRUISERS

Economic Front (EF) leader Wynter Kabimba has written Local Government Garry Nkombo giving him seven days within which to cancel the purchase of 156 4×4 Land Cruisers, failure to which he will commence judicial review proceedings in the High Court to annul the same.

In a letter addressed to Nkombo dated September 21, 2022 and seen by Daily Revelation, Kabimba argued that the CDF guidelines do not permit the Ministry to centrally procure the said motor vehicles.

“We refer to the above matter and also the press release by the Public Relations Officer in your Ministry on Tuesday 20th September, 2022, regarding the same and please note that we act for the Economic Front Party in this matter and hence note our interest. It is our client’s instructions that the CDF guidelines referred to in the press release by the PRO do not permit the Ministry of Local Government to centrally procure the said motor vehicles without any recommendations from the respective constituencies,” Kabimba stated. “This position is confirmed By Honourable Miles Sampa, MP for Matero Constituency in Lusaka in a telephone interview Seniya Banda Of Millennium Tadio.”

Kabimba stated that in view of the foregoing, Nkombo’s decision to procure the motor vehicles in question is ultra vires the provisions of the CDF Act and its supporting guidelines.

“It is, therefore, our client’s instructions that unless you give us evidence that the said transaction has been cancelled within 7 days from the date hereof, we shall proceed to commence judicial review proceedings in the High Court for a Writ of Certiorari to have the same annulled accordingly,” stated Kabimba. “We hope you shall not allow our clients to take the route which will attract unnecessary costs.”
