Inspector General of Police Graphel Musamba says Socialist Party (SP) leader Dr Fred M’membe is a free soul to sue him, but must know which procedure to follow
Speaking with Daily Revelation on the action by Dr M’membe to sue him for criminal libel, Musamba said Dr M’membe had his own constitutional rights.
“He’s a free soul to sue. He can sue you know for whatever he thinks is right. That’s all I can say. He’s a free soul,” he said.
Asked if he is ready to defend himself in court on the allegations raised against him, Musamba said: “If he raises charges against me, he knows what channel to take.”
But Dr M’membe has argued that he could not handle the matter by reporting it through the police processes as the matter would not go anywhere since Musamba commands over the entire police and therefore had to go directly to the courts, Musamba insisted that Dr M’membe is a free soul.
“A free soul empowered by the constitution. Thank you,” said Musamba.
Dr M’membe has sued Musamba for criminal libel after Musamba said that Dr M’membe’s statements are inciting peace loving Zambians into civil disobedience.
Musamba in his recent press briefing said: “Bringing of military coups or let me just say the relevant of coups from west Africa into this country we are wondering if this is the philosophy of socialism.”
Dr M’membe argues that he has been advised by his counsel that the conduct of the now accused is criminalised under section 191 of the Penal code CAP 87 of the laws of Zambia.
